A RECENT MAJOR VICTORY ON A WHITE-COLLAR CASE IN THE FORM OF A PREEMPTIVE STRIKE: AFTER THE CLIENT'S
BUSINESS WAS RAIDED BY AUTHORITIES WE PREVENTED CHARGES FROM BEING FILED. CLIENT NEVER SPENT A DAY
IN JAIL - AND CIVIL SUITS ARE NOW PENDING AGAINST THE AUTHORITIES.
Client is the owner of a major RV dealership in Turlock, CA. The District Attorney was threatening to charge him with over
700 counts of fraud and grand theft based on property/evidence that they seized during a raid. This would have destroyed
his business and would very likely have put him in prison for decades.
Working together with two excellent civil-law attorneys (Peter Rausch and Joe Ferraro) we filed two complex
quasi-criminal motions. Additionally, my frequent co-counsel/associate and mentor, Attorney Daniel A. Horowitz, also
provided us with invaluable advice. (Dan is currently representing Oksana Grigorieva against actor Mel Gibson and his
army of attorneys)
After two very contentious, hours-long hearings, I successfully argued that the authorities had violated our client's Fourth
Amendment Rights, and that they must return all the property/evidence that was seized. The final hearing was litigated on
November 3rd 2010. The Judge's Ruling on the Motion is linked below.
